Legal action to delay or prevent wind energy development
Litigation is a popular strategy to resist the development of wind turbines in Germany. As of 2019, 325 wind projects were held up or delayed because of court cases. Most of these court cases are premised on threats to nature conservation.
In Germany, litigation against wind turbines can be an effective strategy with many developments either substantially delayed or halted completely. In 2020, the German Government passed the Investment Acceleration Act in order to speed up wind development by limiting contestation in the lower courts. This has made litigation a less popular and successful coping strategy.
